By accessing or using the MaxxTune website (maxxtune.in) or placing an order through our platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy, Returns & Refunds Policy, Cancellation Policy, and Disclaimer.

If you do not agree to these terms, you must discontinue use of our platform immediately and refrain from placing any orders. MaxxTune reserves the right to update or modify these terms at any time, and your continued use of the platform following such changes constitutes your acceptance of the revised terms.

You must be at least 18 years of age to use our platform or purchase our products. By placing an order, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

Our products are intended for delivery within India only. Orders placed with addresses outside India will not be processed.

Placing an order constitutes an offer to purchase. A binding contract is formed only upon our confirmation of your order via email. MaxxTune reserves the right to refuse or cancel any order at our discretion — including in cases of pricing errors, suspected fraud, or stock unavailability — with a full refund issued where payment has been collected.

Payments are processed securely through our third-party payment provider. MaxxTune does not store your payment credentials. By completing a purchase, you confirm that you are authorised to use the payment method provided.

In the event of a failed or disputed payment, MaxxTune reserves the right to place the corresponding order on hold until the matter is resolved.

Delivery timelines provided at checkout are estimates only and are not guaranteed. MaxxTune shall not be held liable for delays caused by courier partners, natural events, government restrictions, or other circumstances beyond our reasonable control.

Risk of loss and title for products pass to you upon dispatch from our facility. It is the buyer's responsibility to inspect all deliveries upon receipt and report any damage or discrepancies to our support team within 48 hours of delivery.

MaxxTune does not require customers to create an account to place an order. All purchases are completed as a guest using your name, email address, delivery address, and payment details. Your personal information is collected solely for the purpose of processing and fulfilling your order.

By submitting an order, you confirm that all information provided is accurate and complete. MaxxTune shall not be held liable for failed or delayed deliveries resulting from incorrect information provided at the time of checkout.

All content on the MaxxTune platform — including but not limited to the brand name, logo, product descriptions, images, graphics, and website design — is the exclusive intellectual property of MaxxTune and is protected under applicable Indian intellectual property laws.

You may not reproduce, distribute, modify, or exploit any content from this platform for commercial purposes without prior written consent from MaxxTune. Unauthorised use of our intellectual property may result in legal action.

The MaxxTune platform and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, MaxxTune disclaims all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. Please refer to our Disclaimer for specific terms relating to the road legality and compliance of our products.

To the maximum extent permitted by law, MaxxTune and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the platform or our products.

In any event, MaxxTune's total aggregate liability to you for any claim arising out of or in connection with these terms shall not exceed the amount paid by you for the specific order giving rise to the claim.

These Terms of Service are governed by and construed in accordance with the laws of India, including the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Indian Contract Act, 1872.

Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand, India. By using our platform, you consent to the personal jurisdiction of such courts.

In the event of any dispute, claim, or concern arising from your use of the MaxxTune platform or the purchase of our products, we encourage you to contact our support team in the first instance at support@maxxtune.in. We are committed to resolving all issues fairly and promptly through direct communication before any formal legal proceedings are initiated.

Consumers may also approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, if a satisfactory resolution cannot be reached.
